Welcome to MailForge ("MailForge", "we", or "us"). We provide email delivery infrastructure as a software-as-a-service (SaaS) product. By creating an account, subscribing to any plan, purchasing credits, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read, understood, and agree to be bound by these Terms; (c) agree to our Privacy Policy; and (d) are authorized to enter into this agreement on behalf of yourself or any organization you represent.
⚠️ Important: If you do not agree to these Terms, you may not use the Service. Continued use after any update constitutes acceptance of the revised Terms.
2.1 Service Provided
MailForge provides an AI-powered email API platform enabling users to send transactional and marketing emails via REST API or SMTP, with features including React Email templates, DKIM/SPF/DMARC authentication, webhooks, and real-time analytics.
2.2 Nature of Service
This is a digital intangible product. Service access is enabled immediately upon payment confirmation. Due to the immediate delivery nature of digital services, refunds are subject to specific limitations (see Section 7).
2.3 AI Features
This service uses third-party AI model providers including OpenAI and Anthropic. Service performance and availability may be affected by these providers' operational status. Significant disruptions will be communicated to users promptly.
3.1 Account Creation
Using this service requires creating an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all operations under your account.

Current plan details and pricing are available at https://mailforge.dev/pricing. We reserve the right to modify plan features or introduce new plans at any time. Price changes follow Section 5.1.
5.1 Auto-Renewal Authorization
By providing a payment method and subscribing to a paid plan, you explicitly authorize MailForge to periodically charge your payment method for the corresponding subscription fee. This periodic authorization remains effective until you cancel your subscription per Section 6.
Your subscription auto-renews at the end of each billing period unless cancelled. For annual subscriptions, we will send a reminder before renewal.
5.2 Taxes
Unless otherwise stated, all prices exclude applicable taxes (including VAT, GST, sales tax, etc.). Where required by law, we will collect and remit applicable taxes.
5.3 Payment Processing
All payment card data is exclusively processed by our PCI-DSS compliant payment processor, Waffo Pancake. We do not store complete card numbers on our servers.

You may cancel your subscription at any time via:
Cancellation takes effect immediately. We will send a confirmation email within 10 minutes.

Due to the immediate delivery nature of our digital service, subscription fees are generally non-refundable, except as follows.

Send refund requests to refunds@mailforge.dev with your account email, transaction ID, and reason. We confirm within 2 business days and process eligible refunds within 5-10 business days.

If you believe a charge is in error, please contact billing@mailforge.dev before initiating a dispute with your bank. We commit to responding within 2 business days and resolving confirmed billing errors within 5 business days.
9.1 Output Content Ownership
Subject to compliance with these Terms, AI content generated from your inputs ("Output Content") belongs to you. You may use Output Content for any lawful purpose permitted under Section 10.
9.2 Input Content License
By submitting content to this service ("Input Content"), you grant MailForge a limited, non-exclusive license solely for providing the service to you. We will not use your Input Content for AI model training without your explicit consent.
9.3 Third-Party AI Models
This service uses third-party AI model providers including OpenAI and Anthropic. Output content may be influenced by these providers' models. We do not guarantee specific output quality and are not liable for content generated by third-party models.
9.4 AI Output Accuracy
AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and verifying output content before relying on it.

This service is provided "as is" and "as available" without any express or implied warranties, including merchantability, fitness for a particular purpose, or AI output accuracy.
12.2 AI Output Disclaimer
⚠️ This service's AI output may be inaccurate, incomplete, or outdated. Do not use it for legal, medical, financial, or other professional advice. Always verify with qualified professionals before acting on AI-generated content.
12.3 Limitation of Liability
To the maximum extent permitted by applicable law, MailForge is not liable for any indirect, incidental, consequential, or punitive damages. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.
These Terms remain effective during your use of the service. We may suspend or terminate your account if you materially breach these Terms, engage in fraudulent activity, or when required by law. If we terminate for reasons not caused by you, we will refund prepaid unused portions pro-rata. You may delete your account at any time by contacting support@mailforge.dev.
These Terms are governed by applicable law. Before initiating formal proceedings, please contact legal@mailforge.dev to attempt informal resolution.
We may update these Terms at any time. Material changes will be communicated at least 15 days before taking effect via email. Continued use constitutes acceptance of revised Terms. If any provision is found invalid, the remaining provisions remain fully effective.
